You may unsubscribe at any time by clicking the unsubscribe link in any email or by contacting us directly. Subscriber accounts that save speed test results are provided on an "as is" basis. We do not guarantee the perpetual availability of stored test results and are not liable for any loss of stored data.
The Site and its original content (excluding content provided by Users), features, and functionality are and will remain the exclusive property of SpeedsTests.com. The Site is protected by copyright, trademark, and other laws of the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of SpeedsTests.com.
If we allow you to post, submit, or display content (such as comments or submitted claims), you grant us a non-exclusive, worldwide, irrevocable, royalty-free license to use, copy, modify, distribute, and display such content in connection with the operation of the Site. SPEEDSTESTS.COM DOES NOT WARRANT THAT THE SITE OR ANY CONTENT, SERVICE, OR FEATURE OF THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SPEEDSTESTS.COM, ITS OWNER(S), DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; (III) ANY CONTENT OBTAINED FROM THE SITE; (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (V) SPEED TEST RESULTS OR ANY ACTIONS TAKEN BASED ON SPEED TEST RESULTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED U.S. DOLLARS ($100.00 USD).
You agree to defend, indemnify, and hold harmless SpeedsTests.com and its owner(s), employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Site; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your use of the Site caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Site.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to its conflict of law provisions. You agree that any legal action or proceeding between you and SpeedsTests.com for any purpose concerning these Terms or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in the State of New York. You consent to the personal jurisdiction and venue of such courts and waive any objection based on inconvenient forum.
Any dispute arising out of or relating to these Terms or the Site shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, with the arbitration taking place in New York, New York. The arbitrator's decision shall be final and binding. YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST SPEEDSTESTS.COM ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
The failure of SpeedsTests.com to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of SpeedsTests.com.
These Terms, together with the Privacy Policy, Disclaimer, and Affiliate Disclosure, constitute the entire agreement between you and SpeedsTests.com regarding the use of the Site, superseding any prior agreements between you and SpeedsTests.com (including, but not limited to, any prior versions of the Terms).
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.
